Terms of Service
These Terms of Service ("Terms") govern your use of the Klickly service operated by White Flocs SL (NRT L-714911-J), with registered office in Encamp, Principat d'Andorra ("Klickly", "we", "us").
By creating an account or using Klickly, you agree to these Terms. If you do not agree, do not use the service.
1. Who you are contracting with
This section is important — please read it carefully.
- Use of the Klickly service (your account, your smart links, your dashboard, your analytics) is governed by these Terms and is provided by White Flocs SL.
- The sale of paid subscriptions to Klickly is conducted by Paddle.com Market Ltd ("Paddle") acting as the Merchant of Record. When you purchase a paid plan, your contract of sale is with Paddle, not with White Flocs SL. Paddle issues the invoice, charges VAT or sales tax where due, handles chargebacks, and processes refunds. Paddle's own terms apply to the purchase transaction and are available at paddle.com/legal.
White Flocs SL receives net payouts from Paddle. We do not see or store your card details.
2. Eligibility and accounts
- You must be at least 16 years old to use Klickly.
- Klickly is currently in invitation-only mode. You can only create an account if you have received an invitation. We may close registrations at our discretion.
- You are responsible for keeping your password and any OAuth account used to log in secure. Notify us at security@klickly.app if you suspect unauthorised access.
- One account per natural or legal person, unless you have an Agency or Enterprise plan that explicitly allows team seats.
3. The service
Klickly provides:
- short branded smart links served from klck.link with a customisable landing page
- real-time click analytics
- monitoring of public Instagram profiles (without logging into the profile owner's account)
- pixel injection for the customer's own GA4 / Meta Pixel on the customer's smart links, on plans where that feature is enabled
Plans: Starter (free), Individual ($9/month), Pro ($29/month), Agency ($69/month), Enterprise (custom). Limits, quotas and feature availability per plan are described at klickly.app/#pricing and may change with reasonable notice.
Fair use
Paid plans are offered on a fair-use basis. We may rate-limit, throttle, or contact you if your usage is materially out of proportion to typical usage on your plan (for example, sustained API traffic that disrupts service for other customers). We will not silently degrade your service without first reaching out.
4. Payments, billing, and refunds
- Billing. Subscriptions are billed monthly or annually in advance through Paddle. Prices are shown in USD; Paddle may convert to your local currency and add VAT or sales tax.
- Renewal. Subscriptions renew automatically until cancelled. You can cancel at any time from your Klickly dashboard or via the Paddle receipt link. Cancellation takes effect at the end of the current billing period.
- Refunds. You may request a full refund within 14 days of your first purchase of a paid plan. After 14 days, fees already paid are non-refundable and we do not prorate cancellations. Statutory consumer rights under the law of your country of residence are not affected.
- Disputes. Please contact support@klickly.app first; we want to fix issues directly. If a refund or dispute cannot be resolved with us, you may escalate to Paddle, who as Merchant of Record retains the final decision on refunds and chargebacks.
- Failed payments. If a payment fails, Paddle will retry per their schedule. If the payment is not recovered, we may downgrade your account to the Starter plan and restrict paid features.
5. Acceptable use
You agree not to use Klickly to:
- carry out activities that are illegal under the law of Andorra, the European Union, or your country of residence
- distribute malware, phishing pages, or fraudulent content
- host smart-link destinations that violate Meta's or Instagram's terms (we will suspend smart links pointing to such destinations on credible report)
- scrape Instagram or any third-party platform at industrial scale, evade rate limits, or attempt to access non-public data. Klickly's own monitoring only reads public profile data within reasonable rate limits; you may not use the platform as a scraping tool against competitors
- send unsolicited bulk communications (spam) using Klickly-generated links
- host or distribute child sexual abuse material, content inciting violence or hatred against protected groups, or any content that violates Andorran criminal law
- attempt to compromise the security, integrity, or availability of the service, or probe for vulnerabilities outside of a published responsible disclosure programme
We may suspend or terminate accounts that breach this section. For serious or repeated violations we will do so without notice.
6. Your content and intellectual property
- You retain ownership of all content you upload to Klickly — landing pages, copy, images, brand assets.
- You grant White Flocs SL a non-exclusive, worldwide, royalty-free licence, limited to what is technically necessary to host, serve, cache, and display that content through the Klickly service, for as long as you keep it in your account.
- You represent that you have the rights to the content you upload and that it does not infringe third-party IP, privacy, or publicity rights.
- Klickly and the Klickly logo are trademarks of White Flocs SL. The software and design of klickly.app and the klck.link landing pages are owned by White Flocs SL. Nothing in these Terms grants you any right in those marks or software beyond using the service as intended.
7. DMCA and copyright notices
If you believe content hosted on klickly.app or klck.link infringes your copyright, send a notice to dmca@klickly.app that includes:
- your physical or electronic signature
- identification of the copyrighted work
- the URL of the allegedly infringing material
- your contact information
- a statement of good-faith belief that the use is not authorised
- a statement, under penalty of perjury, that the information is accurate and that you are authorised to act on behalf of the rights holder
We will respond within a reasonable time, and may remove or disable access to the material. Repeat infringers will have their accounts terminated.
8. Warranties and disclaimers
To the fullest extent permitted by law, the service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy of analytics, uptime, or non-infringement. Statutory consumer warranties in your country of residence are not excluded where they cannot be excluded by contract.
9. Limitation of liability
To the maximum extent permitted by law:
- White Flocs SL will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, or data
- our total aggregate liability under or in connection with these Terms is limited to the amount of subscription fees you have paid for the Klickly service in the 12 months preceding the event giving rise to liability
- nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, gross negligence, death, or personal injury caused by negligence
10. Suspension and termination
- You may close your account at any time from your dashboard. Closure takes effect immediately; we retain account data for 90 days after closure for dispute resolution, then delete it (see the Privacy Policy).
- We may suspend or terminate your account for cause (breach of these Terms, non-payment, abuse) with notice where reasonably practicable, or immediately for serious breaches.
- We may terminate accounts without cause on 30 days' written notice. If we terminate a paid account without cause, we will refund the unused portion of any prepaid fee on a pro-rated basis through Paddle.
- On termination, your smart links will stop resolving and your data will be deleted in accordance with the Privacy Policy retention schedule.
11. Changes to the service and to these Terms
We may modify the service over time. We may also modify these Terms. Material changes will be communicated by email to active account holders at least 14 days before they take effect. Your continued use after that period constitutes acceptance. If you do not accept the changes, you may close your account; if you had a prepaid paid plan, we will refund the unused portion via Paddle.
12. Governing law and jurisdiction
These Terms are governed by the law of the Principat d'Andorra.
Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of Andorra la Vella, except that:
- if you are a consumer habitually resident in the European Union, you may also bring proceedings in the courts of your country of residence, and you retain the protection of mandatory consumer-protection rules of that country
- you may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr (for EU consumers)
13. Language
These Terms are written in English, which is the authoritative version. Any translation we may provide is for convenience only.
14. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, the Cookies Policy, and any plan-specific terms, are the entire agreement between you and White Flocs SL regarding the Klickly service.
- Assignment. You may not assign these Terms without our consent. We may assign them as part of a merger, reorganisation, or sale of substantially all our assets.
- Severability. If any provision is held unenforceable, the rest of the Terms remain in force.
- No waiver. Failure to enforce a provision is not a waiver.
- Force majeure. Neither party is liable for delays caused by events beyond reasonable control.
